Legal basis: Regulation (EU) 2023/988 on General Product Safety (GPSR), in force since 13 December 2024.

Our Role as a Marketplace

smartport operates an online marketplace on which professional merchants offer products. We ensure that only merchants who comply with their statutory product safety obligations are active on our platform.

We require all merchants to:

• Provide complete and accurate product information including safety-relevant features
• Make the required GPSR documents available at the time of listing (e.g. CE declarations of conformity, energy labels)
• Respond promptly to safety warnings or recalls

Reporting Unsafe Products

If you believe that a product offered on our platform poses a risk to safety or health, please report this without delay:

Subject: GPSR – Product Safety Report

Please include:

• Product name and item/order number
• Description of the safety risk
• Photos or other evidence, if applicable

We process safety reports as a priority and take immediate action where there is reasonable suspicion, including temporary delisting of the product.

Action in Case of Safety Issues

If a safety issue becomes known:

1. Immediate suspension of the affected listing
2. Notification of the merchant and request for comment
3. If the risk is confirmed: permanent delisting and notification of the competent market surveillance authority
4. Information of affected buyers where necessary and possible

RAPEX / Safety Gate

Products reported in the EU rapid alert system Safety Gate (formerly RAPEX) are removed from our platform. Merchants are obliged to inform us without delay about recalls or safety warnings concerning their products.
